Do I Move Out at Foreclosure?

Question: My lender started the foreclosure process. Should I move out?

Answer: Foreclosure is a long process, and the logistics differ from state to state. It may take a while before somebody else takes possession of the home, so you have to decide when to move out. Talk to a local attorney if you’re not sure what to do.

It’s often safer to stay in your home until the court orders you to leave. As the owner, you’re responsible for the property. If you move out before then, a number of things could happen: squatters could move in, scavengers may strip out fixtures and metals, or vandals might cause cosmetic damage. When those things happen, your home loses value.

You may not think your home’s value matters anymore, but you may be financially responsible for things that happen after you leave. If your home sells for less than you owe, your lender might be able to come after you for the difference (or "deficiency").

You can also run into complications if somebody is injured or sells illegal drugs on your property.
